Trademark question

Clip to ScrapBook #1

This summer I created a sight word program that I started to use in my classroom and have seen amazing results! For the program I drew original artwork and recorded and sang original songs. I'm started to throw around the concept of trademarking the program. The problem is I have no clue how to do that! I am selling it in teachers pay teachers, but I would love for it to be something that is taught in classrooms. Like how schools buy jolly phonics and then use the program in the classrooms. Anyone have any knowledge on this?

My cousin is a trademark attorney. I'd start there; contact a trademark attorney and ask what the process is.

Copyright and licensing law

I think what you're looking for first is copyright. I don't think the laws have changed, so in general, your original written work is automatically copyrighted and cannot be taken by someone else. You cannot copyright content, just the exact way you represent it. To sell to schools, you'd have to set up a company and create some sort of licensing structure. You definitely need a business attorney for both things.

There is some helpful information on the US Trademark website too. I found this video very helpful when thinking about trademarking my business name. http://www.uspto.gov/trademarks/basics/
