Hi everyone,
This is what I've found, we're stuck in pending because CA EDD has flagged all school employees.

In my district the plan for reopening will be announced on June 30. I also know that the health department has told one of my principals that her classrooms can hold no more than 9-12 students and be in compliance for social distancing in all grades. Therefore there is no reasonable assurance of anything until June 30th. So just pay us until the district figures this out. This counters everything that is stated on the EDD website.

Edd cannot know how this job really function there are no guaranteed job because any job can go to someone on the list randomly. Now I know some of us get called by favorite schools at times,but most of my jobs come from my own initiative. I know this will play out with out much in the way of jobs. If a district is distance learning for most students, and training is also distance held. It is'nt hard to see what could really happen this school year. If your young enough I guess you can ride out this year as it unfolds, but for me I only am working a few more years. They finally gave us a decent pay for daily work after the many years of being underpaid. Really I think the new normal as people are calling it, may apply to schools.

I typically work 5 days a week and all but 4 of my jobs last year were booked well in advance due to teacher meetings and trainings with a few personal days off here and there. Those meetings and trainings will not be happening which means very few jobs. Therefore, I will basically be unemployed.

Hi everyone,
My claim is still in pending, I sent EDD an email questioning my pending status and request them to clarify their own school employees/sub teacher eligibility criteria for UI benefits. (I send the email through their message tab on my UI account, I hope they see it).
I found the actual EDD News Release that was sent out on 6/18/20:

You're right Tapdancesub, This contradicts what EDD states on their site:

The Letter of Reasonable Assurance is just to protect Districts from unemployment claims during breaks. The excerpt below explains just that, plus it states how subs have a right to UI benefits should their income fall during a semester through no fault of their own.

Northcalsub: I agree, EDD has zero clue as to how this job really works, they must really believe that "reasonable assurance" means that we will have job security come any new school year, not knowing that it's really a way to block our pay during the summer (actually I think they really do know this- it's a game they participate in) and to create a list of possible coverage, It's just a possibility of work- not really any assurance of work.
I hope all of you that are still waiting to certify this coming weekend are able to get payed, I hope we all do.

What was the last week you were paid for? The last week I certified for has been pending for over a week now. My afternoon is pretty open, so I may just jump on the phone while I fold laundry.

When was the last date you certified please?

This topic is covered in a few social media outlets, Substitute teachers are really concerned about this. I wonder why the US Department of Labor Control thought it was a good idea to treat this year as any other year when it comes to LRA's, especially when our LRA is more like a "maybe, but yeah, not likely" possibility of assignments come Fall semester. And then...I quickly remember the Real reason behind those LRA's. - so it makes sense.

Hmmm, thinking it ties in with reducing the number of UI claims to project more "favorable" unemployment numbers across our country in the summer months, btw, this isn't only happening in CA.

I'm working on an assignment online, but, I will be calling them as well. Peace.

Mine says I need to check back on 7/5 to recertify. The last weeks I certified and received payments for were for 5/30 and 6/6. I haven't been able to get a hold of anyone over the phone and I haven't received an answer to the message I sent them. It does say it can take 5-7 days though.

I tried on the phone the other day, but could not hold any longer. Yesterday I sent an email, I'll give them 7 days to respond. If I don't hear back, I'll get on the phone again. I"ve gotten all my big COVID projects done around here, so I have plenty of time to argue with them now.

The link above (prob have to login) details information about school employees of which substitutes are considered as such. However, that newsletter does specify:

You may not be eligible to receive benefits based on wages earned if all of the following occur:

A claim is filed during a recess period.
You receive an offer to return to work for a school employer when the recess period ends.
You earned school wages during the base period of the claim. A base period is a specific 12-month term used to see if you earned enough wages to establish a UI claim. To learn how we determine your base period
What confuses me is the

In the Unemployment Insurance (UI) program, school employee and school supportive employee claims have specific eligibility requirements. You are still considered to be employed when on a break or recess. Because you will return to work, you are not unemployed through no fault of your own.
I have two weeks 'pending' and the 'normal' district ending of school date was 6/4/20.

Week 1 Certification Status
Pending for week ending 06/13/2020

Week 2 Certification Status
Pending for week ending 06/20/202

This is not good news but at least I got almost ~$7,200 for the weeks qualified for. It's no surprise that you have to 'search' for news about the stipulation. They obviously don't send you notification but assume you know.

Another 'Stimulus' check for $1200 would help if they pass another.

I just want to share what I've found out:
We should be receiving a questionnaire from EDD about our status as school employees.
Some school employees should not have been flagged, so it is believed that EDD will release all those stuck on pending and mail this questionnaire to everyone, it will either come with an interview date and/or with instructions to mail the questionnaire back to them.
Schedule maintenance on EDD site= unflagging school employees/release Pending status?? Hmm?
Payed while EDD sorts this out? Let's hope so.
Jakeh: I've tried to make sense of that same regulation...

I was on the phone half of the day on Friday with no luck. I have a few deadlines these next couple of weeks, but I will try to stay on top of this. When we do call, we need to get to a Tier 2 Claim Specialist; they might have a call- back list going on. Let's hope this gets resolved.

I found this on the UI Edd website. I'm wondering about this because I received my letter of reassurance and it does state that I may be called in durine summer recess. So, seems like we would qualify if we meet one of these items...I'm crossing my fingers

Fairly encouraging. I recertified on 6/21, still pending. Not to poo-poo on your post but with the current posts, it looks like they will be calling us for the 'spotlight on chair, Kafkaesque' interview. I'm not that optimistic, but, hey, maybe this will turn around. Our governor, Newsom, is a jerk, and I think it's only Calif subs that are being cut off (pos per his 'mandate' and we all know his ludicrous mandate very well here in this state).

Pending for the weeks ending 6/13 and 6/20. I have reached EDD on the phone and have been told that all accounts for educators in California were flagged and that they are being looked individually to reassess amounts that might be owed to educators, and that there is a special group of EDD employees that have been designated to deal strictly with California educators. I have yet to be paid for these weeks and they still show pending even though my districts were in session and I actually had jobs that got canceled. They definitely owe me for those two weeks! Supposedly Iím going to be receiving a phone call and I am supposed to be available to take the call which will come from a private number anytime between 8 AM and 8 PM seven days a week. As for summer pay, I am pretty sure that they are going to use the letters of assurance that we received as a way to not pay us, even though no school district right now can really give us any assurance that there will be work come fall. Certainly not the amount of work we were used to getting in previous years.

I was in pending and I just checked and I was paid!!! Hope I dont have to pay it back...there is hope for all of us...I think maintenance was to unflag school employees. Please check your accounts.

That's good news Calsubteacher!! Gives me hope!
Do you work at a year round district where sub teaching assignments are offered during the summer? An LRA on File? I'm just tying to understand this mess, I hope the DOL is having a change of heart with our claims, there is another round of maintenance schedule for the 30th, crossing fingers.

I work at a school district that is on a traditional school year. August-June then with summers off (june 7th - august 17th). My school district does offer summer school. In my LRA it had 2 paragraphs. First paragraph had a sentence that said " you may be called to work over summer recess" . Maybe this was my ticket to getting unemployment but i dont know. The next paragraph was about reassuring me that i had a job for the coming year. I'm wondering if I will get unemployment the whole summer recess. I will try not to get my hopes up. But I guess we will see.
I'm not too sure if my district provided the LRA . I was just in pending and then I got paid a week later. I didn't speak with anyone from EDD. I am going to keep my fingers crossed for all the subs out there, that we all get paid over the summer break.

ok, thank you, mine is carefully worded, it says:
I have reasonable assurance to return to work for the 20-21 skl yr,
I also have Reasonable Assurance of returning to work as an on call certificated substitute at the close of all holidays and recess periods during 20-21 skl yr,
Assignments are NOT contingent on enrollment, funding, or program changes
Certificated Substitutes WILL NOT be needed during the summer.
Yeah, my district knew what is was doing, I think our school calendar yr goes from July to June,have to check.
I'm still hopeful that the DOL in CA has had change of heart with all substitutes, including certificated substitutes that are in the same situation I'm in. They have to know we won't be returning to same amount of assignments pre-covid. We shall hope and keep faith.

You know, I'm still hopeful for a positive resolution to this mess, but I was also thinking; 23 wks of UI benefits is going fast. Come the last wk of Aug.- it'll be up. If we max out on our UI benefits, whose to say they will extend our benefits and/or if I will qualify for another assistance program given my district's restrictions. I love my district but wish it weren't that harsh with those of us that have been there for sooo many years. Without a CARES award- $480 a wk isn't much. Btw, there is a petition online to extend the CARES program, I'll see if I can find it and post it. See, ending with a bit of hope.

Just received a text from EDD that I got payed. Logged into my account and sure enough- The two weeks pending are now paid, 6/7 & 6/13. I hope we hear from CA DOL or EDD about what their plans are moving forward for all substitute teachers regarding summer pay. I guess I should be used to this lack of communication towards subs huh , I hope I don't have to repay this mula though, Counting my blessings.

I am not so lucky. On Saturday I got the notice in the mail to re-certify for the upcoming weeks, but it was not accompanied by a check. The two always come together.

Why are they sending re-certification forms by mail if we are no longer getting paid?

I did just notice that it says "paid" on line for June 7-20.

I hope a check does arrive.

Got an email 7/1 paid for 6/20;6/27. I mail in my certification,on Sunday 28th. So it took only a few days after that.I have a debit card and don't get a check. However, I was never able to enroll my car w/ B of A, so I'm keeping all inbox messages and my receipts. I will at some point reconcile the account.I know this is very nerve wracking for us all, but it looks like at some level of government, they have made a decision, that this is not a regular set of circumstances that we have all worked under for years. I really we had some kind of state level even national representation. In the past as we know school districts would have a hard time with out our on going dedication. I for one miss only a few days in any year. This year, however, I have not made up my mind what I will do, or what precautions I will take for my self. I think it will be limited days for daily subs to fight over.

CC96, I'm sorry that you're still stuck in pending. Yes, you deserve to get paid. From what I'm reading, there are many ppl still stuck in pending from those wks, so maybe it's a glitch and it might resolve itself next time you certify?(crossing fingers), just a thought. In any case, I agree-- calling EDD is best. Wishing you much luck on Monday so that your claim moves forward and you get payed asap.
