I had posted earlier about how my mom’s bank had taken over a month to get back with me about power of attorney paperwork. They said I’d hear from someone today. She finally called.

THEY DECLINED THE PAPERWORK!

They said that the first initials don’t match the rest of them. They do look different because it was on a rough surface, and we didn’t realize it until after the fact. They need a whole new set of paperwork. Can we just being a new page? Nope. Whole new 13 page document required. I explained that she was very sick and probably not able to write now. Mentally fine, but physically not. I asked what I needed to do, and was basically told that was my problem to figure out.

We reprinted new documents, and tried to get her to sign them. She tried, but her meds make her have shaky hands and blurry vision. She tried for an hour to sign her name. I finally told her she didn’t have to do worry about it and had her take a nap.

Meanwhile, DH calls a lawyer. He said that since the document was signed by two witnesses and notarized, it didn’t matter if the signature looked like anything at all because notarizing is proof that the person who signed was indeed the actual person.

So, DH is going to the bank tomorrow with original document and, maybe, new document in hand and seeing what he can get done. He is going to ask two questions his lawyer wants to know answers for . . .

1. What grounds do you have for refusing a witnessed & notarized legal document?

2. Why did it take 6 weeks to process a completed document?

I hope this is settled tomorrow and that you will then remove all your money from that bank. They shoudl be ashamed of themselves.

I'm so sorry you and your mom and DH are having to deal with this right now. There is no reason for the bank to handle things this way. So frustrating, I know. Thanks for keeping us updated. Sure hope your DH gets positive results tomorrow.

Life is complicate enough right now with out your bank inventing a speed bump for you. Hopefully, your DH can give a wakeup call to the powers that be and they'll accept your paper work. I'm sorry your lawyer had to get involved.

My brother was in the hospital and basically on his death bed. I had to get him to sign some papers (I think they were for Medicare) and he could barely hold the pen. It truly broke my heart because he had to sign his name about 7-8 times in the packet of papers. I felt like I was torturing him and I don’t think even two of the signatures looked as if they were from the same person. Our loved ones deserve better and so do the caregivers! Hope this is quickly resolved!

Oh dear lord.......is there no compassion anymore? I, too, am angry on your behalf.

The upside? DH and I have been talking about updating all our paperwork for at least two years. Making an appointment tomorrow. I am hoping we can get something in writing says at X age, one of DDs needs to be put on checking account, et .

Someone must know, but I do not. There has to be a bank regulatory body, either at the state or federal level (might depend on whether this bank operates in multiple states). Find out what it is and file an official complaint. This is bogus.

Also many state and federal representatives have someone on their staff who is available to assist their constituents with various problems. Right now everyone may be focused on the elections, though.

If you are willing to be visible, you might try writing about your experiences: Facebook, Yelp, Twitter, Instagram, NextDoor. Anywhere and everywhere. Get their attention.

This is horrible! I'm glad you called a lawyer.

It sounds like some little power hungry bank bureaucrat flexing their little power.

I hope you don't have to get the lawyer more involved.
