Can some one explain to me the similarities and differences between Tier 3 of RTI and special ed?

Tier 3 is still the process of RtI. Special education is when students have gone through the process and have an IEP (Individualized Education Plan) which is a legal document that the district is required to follow. In tier 3 there is no legal document although you are collecting data to determine whether or not students are making progress. In RtI it's fluid, students are moving in and out of all the tiers. To move out of SpEd, meetings must be held and kids need to be dismissed after meeting their individual goals. In my experience, I have never had a kid move to tier 3 and NOT qualify for SpEd.

Both tier 3 and SpEd should be in small groups, both require collection of data and working on specific skills/areas of weaknesses. When I was teaching SpEd I had tier 3 kids and Sped kids all together (although we found out that's against IL state law). The biggest difference is the legality of the SpEd documents.
