Question about the law:
The regs say a building is eligible if it is at or above the district poverty average. Then further down it states that a district may designate any building that is at least 35% poverty... So does a building HAVE to be 35% poverty to be Title I or can it be above the district average but less than 35%??

From my limited understanding it's not always the building's poverty level, but the level on the federal census...

I am in a building where 46% are low-income but the town we are in had a census report in 2000 of 32% or something like that...so we don't qualify for school-wide title...at least that's what I've been told.

In my district, a school beomes Title if the free/reduced lunch ratio is 35%(targeted assistance), 40%...School-wide Title.

In our district, schools who have the highest level of poverty can qualify for targeted assisted (when I first started eons ago, I was at a school whose free/reduced lunch was below 30%). Now the school I'm in has 54% and rising but we are still a targeted assisted school. Just because you go over 40% does not automatically mean you have to go school wide. At least that's my understanding.
