Hello! I have a student on my caseload who has ADHD and SLD. He has behavior concerns and has a BIP in place. A meeting has been scheduled to review/revise his BIP (this is the third time revisions have been made) to address behaviors that continue. Although some of his behaviors have been corrected (skipping class, roaming in the halls) other behaviors (noncompliance, not completing any work in class despite assistance from teacher and instructional aid, refusal to do as instructed) have worsened. He is at his 11th discipline referral and according to admin the 12th will be alternative school. If we have to do a manifestation determination, what are the best ways to determine if these behaviors are or are not due to the student's ADHD/SLD? We have had multiple parent conferences, revised his behavior plan and he has been assigned an instructional aid (although this was done a few months ago and it's not a part of his services in his IEP). Are these steps sufficient interventions? What else can be done? We are limited to resources in my district...no school psychologist, no behavior specialist, etc. Thanks for any feedback!

Let's look at SLD first for the manifestation. SLD means that a student has a processing disorder that makes reading, writing, and/or math hard for him. He needs academic accommodations and modifications in order to be successful. I don't see how noncompliance is directly and substantially related to SLD.

ADHD can be harder. ADHD has three possible components: hyperactivity, inattention, and impulsivity. I assume directions are repeated for him so he has multiple opportunities to comply. You would have to look the specific situation and see if hyperactivity, inattention, or impulsivity apply.

If the child has been on a BIP, where is the FBA (Functional behavior assessment) and if there have been 3 revisions, isn't that enough to to show that RTI efforts have not improved and you can now progress with looking at evaluating for a EBD or looking at eligibility for EBD?

What does the protocal from your district say? Is there an admin from downtown in the ESE department that can guide you?

You would really have to examine if all the accommodations and BIP were followed. If the referrals were a result of the IEP not being followed the school shouldn't change the placement.
In my experience classroom teachers have a difficult time following a BIP and providing the accommodations listed in the IEP.

What is EBD and from what state? Indiana has ED emotionally disabled.
