I am working on the formative and summative assessments for comp 4. I am using the assessments that came with the unit I taught. On the bottom of the assessments it says: May be photocopied for classroom use.[/B] Then it has the copyright symbol with the c in a circle with the date 2015 y Lucy Calkins and Colleagues from the Teachers College Reading and Writing Project from Units of Study for Teaching Reading (Heinemann: Portsmouth, NH)

Does anyone know if this means I can also photocopy it for this purpose?

I agree with juzFyne. It's copyrighted. The directions don't give any qualifiers on the copyright issue.

I called NB and they stated because TC authorized it for classroom use that I can use it. Also TC's website advises you to use their assessment prompts and to make them your own. It states so on the assessment book webpage.

"This October, Heinemann will release Writing Pathways, a book and collection of resources by Lucy Calkins with TCRWP colleagues (especially Audra Kirshbaum Robb and Kelly Boland Hohne).

This release brings the assessment system that undergirds standards-based writing workshop instruction to teachers everywhere. This assessment system is foundational to Units of Study in K-8 Opinion/Argument, Information and Narrative Writing—it has been adapted slightly for the new book release so that it is applicable to any classroom, whether or not it follows a workshop approach to teaching writing.

You are also invited to create your own homemade version of this assessment system, as there are extraordinary lessons to be learned from fashioning such a tool together in the company of your colleagues and whatever set of standards you adopt.

Essentially, this is the gist of our tool."

Zia thank you for calling NB. I'm curious, how were you able to reach them?

This is making my life so much easier!!!!!!!!!!!!!!!!!!!!!!!!! !!!!!!!!!!!!
I am so happy!!!!! I am beginning to really stress out about making deadline and this will help me.

Hi! Are you also using TC? I love their reading and writing approach! Thank you for your lengthy response to my question. It is very helpful!! The assessment I am using is for the nonfiction reading units of study for 4th grade. Can I assume that the same rule applies because you wrote about the writing assessments?

I teach writing and social studies for the entire 5th grade. The TC checklists and rubrics are pieces of my evidence so I called

I attend the pd's and social studies institutes there and have asked them as well if it can be used. I read the bottom of the form which gives permission for teachers to copy and use in the classroom. The prompts aren't on a form, you create those forms and use the prompts for assessment. The prompts themselves aren't copyrighted and the website page says to make it your own.

I got different information from NB.
I modified a passage to use for a running record assessment. Another teacher wrote the passage. I modified it to meet my students needs. It is not copy-righted. I emailed to ask question if I could use it. They advised via email that I describe the passage. Here's their response - "The General Portfolio Instructions stress that all of the work you submit as part of your response to each portfolio component must be yours and yours alone. It might be best to provide a description of this material."

I am not going to take any chances. I will just provide a description of the material I used instead of uploading the actual formative and summative assessments as well as the self assessments.

That doesn't have to do with copyrighting but with only you composing the assessment and not the other teacher sharing the duty.

michael, the copyright on that assessment gives you permission to use in your classroom. It doesn't say anything about using it for PD.

Someone posted recently they got different info from NB.

My gut says if you did not create it yourself, describe it and don't submit it. Personally, I wouldn't risk it. But it's your call how you interpret it.

Do you have a CSP to ask?

Zia, what the person mentioned had nothing to do with copyrighted materials.
Michael call NB yourself to get the answer which is at the bottom of Lucy Calkins forms. All of TC's materials are not available to be copied and used the copyright at the bottom is there without extended permission. I wouldn't suggest nor take such a risk if I had not gotten clearance from NB.
